Terms of service

Last updated: 21 July 2026

Welcome to Datum

These Terms of Service govern access to, browsing and use of the website datumcard.es, as well as the purchase of products offered through our online store.

The store is operated by DSJ CONNECT LLC, which trades under the brand Datum. Throughout these Terms, the expressions “Datum”, “we”, “us” or “our” refer to DSJ CONNECT LLC, operating under that brand.

DatumCard uses Shopify technology to host and manage certain functions of the online store.

By accessing our website, browsing it or making a purchase, you accept these Terms of Service, together with the applicable policies published on the site. If you do not agree with these Terms, you must not use the website or make purchases through it.

These Terms do not limit or exclude the non-waivable rights you have as a consumer under European Union law and the mandatory law of your country of residence.

2. Purpose of the services

Through datumcard.es we offer products related to organising, locating and protecting personal belongings, including devices, accessories, card holders, wallets, key organisers, chargers and other products associated with the DatumCard brand.

The services available on the website may include, among others:

  • Viewing products and commercial content.
  • Buying products online.
  • Managing orders and payments.
  • Sending order-related communications.
  • Customer service.
  • Managing returns, exchanges, warranty claims and refunds.
  • Posting or viewing reviews, where this feature is available.

3. Minimum age and permitted use

To make a purchase on datumcard.es, you must be of legal age to enter into contracts under the legislation applicable in your country of residence.

If you use the site on behalf of another person or entity, you declare that you are duly authorised to do so.

The website and its services must be used only for lawful purposes and in a manner consistent with these Terms, the applicable legislation and the rights of third parties.

4. User account

Some features of the site may require you to create an account or enter personal and contact details.

You undertake to provide truthful, up-to-date and complete information. You will also be responsible for keeping your login credentials confidential and for any activity carried out from your account, unless there is unauthorised use not attributable to you.

You may not sell, transfer, assign or allow third parties to use your account without authorisation.

5. Product information

We make reasonable efforts to present the characteristics, images, prices, availability and descriptions of our products clearly and accurately.

Product images are for illustrative purposes. The colour, brightness, texture or visual appearance may vary slightly depending on the device, screen, lighting or settings used by the customer.

These reasonable variations do not affect DatumCard's obligation to deliver products that conform to the description, the advertised characteristics and the legal rights of the consumer.

Where a product includes location features, connectivity, app compatibility or integration with third-party services, these features may depend on compatible devices, software updates, external networks, service availability or technical conditions beyond DatumCard's exclusive control.

References to Apple Find My, Google Find Hub, Bluetooth, MagSafe, wireless charging or other technologies are limited to the compatibility actually indicated on the corresponding product page.

6. Product availability

Product availability may vary. Although we try to keep the information up to date, a product may sell out or become unavailable after the customer has started the checkout process.

If a purchased product is unavailable after the order has been confirmed, we will contact the customer to offer, as appropriate:

  • An equivalent alternative product, if the customer expressly accepts it.
  • Waiting until the product is available again, if applicable and the customer agrees.
  • Cancellation of the order and a full refund of the amounts paid.

7. Orders

By placing an order, you confirm your intention to purchase the selected products in accordance with these Terms and the conditions indicated during the checkout process.

Before confirming the order, the customer must carefully review the products, quantities, delivery address, payment method and other details entered.

Receipt of an automatic email does not necessarily imply final acceptance of the order if there is an obvious error, lack of availability, reasonable suspicion of fraud, inability to deliver or a payment issue.

DatumCard may reject or cancel an order for objective reasons, including:

  • Product unavailable.
  • Obvious error in the price, description or availability.
  • Incomplete or incorrect delivery details.
  • Reasonable impossibility of making the delivery.
  • Payment failure, rejection or reversal.
  • Reasonable suspicion of fraud, abuse or misuse.
  • Orders incompatible with reasonable personal or household use.

If a paid order cannot be accepted or has to be cancelled by DatumCard, the amounts paid by the customer will be refunded, unless there is a legal reason justifying a different course of action.

The products offered on datumcard.es are intended mainly for end consumers for personal or household use. Unauthorised commercial resale is not permitted.

8. Prices, taxes and promotions

The applicable prices will be those shown on the website at the time the order is placed, except in the case of obvious error.

Prices are shown in euros, unless another currency is expressly indicated.

Before confirming the purchase, the customer can see the total price of the order, including applicable taxes and any shipping costs.

DatumCard offers free standard shipping on all orders, under the conditions set out in the Shipping Policy.

Discounts, promotional codes, offers and commercial campaigns may be subject to specific conditions, such as a validity period, minimum spend, stock availability, a limit per customer or incompatibility with other promotions.

DatumCard may change prices, promotions and availability for future orders at any time. These changes will not apply retroactively to orders already confirmed, except in the case of a legally relevant obvious error.

9. Payment

The customer must provide valid, truthful and up-to-date payment information.

By entering a payment method, the customer declares that they are authorised to use it and that there are sufficient funds or authorisation to cover the total amount of the order.

Payments may be processed by external payment providers. The use of these providers will also be subject to their own terms and policies, without prejudice to the consumer's rights against DatumCard as the seller.

DatumCard does not directly store complete card details when these are processed by certified external payment providers.

10. Shipping and delivery

Orders are processed within an estimated 1 to 2 business days of payment confirmation.

Once processing has been completed and shipment has been confirmed, the estimated delivery time is 5 to 10 business days.

Saturdays, Sundays and public holidays are not considered business days. The delivery time is counted from shipping confirmation, not from the date the order was placed.

Where available, the customer will receive a tracking number by email. Tracking information may take between 24 and 48 hours to update after shipping confirmation.

Delivery times are reasonable estimates based on usual logistics operations. Delays may occur due to external causes, such as carrier incidents, weather conditions, customs inspections, strikes, sorting errors or circumstances beyond DatumCard's reasonable control.

These delays do not remove or limit the consumer's legal rights in the event of non-delivery, significant delay or failure to meet the agreed delivery time.

Unless the consumer has engaged a carrier not offered by DatumCard, the risk of loss of or damage to the products remains with DatumCard until the consumer, or a third party indicated by the consumer other than the carrier, acquires physical possession of the product.

For more information, please see our Shipping Policy.

11. Delivery address

The customer is responsible for providing a complete and correct delivery address when placing the order.

If you notice an error in the address, you must contact us as soon as possible at contact@datumcard.com. We cannot guarantee that the address can be changed once the order has been processed or handed over to the carrier.

If an order cannot be delivered due to an incorrect or incomplete address, failure to collect or unjustified refusal to accept the parcel, DatumCard may charge the actual and reasonable costs of reshipping or return where the problem is attributable to the customer and this is legally permissible.

12. Right of withdrawal, returns and refunds

Consumers have the right of withdrawal and the other return and refund rights recognised by the applicable legislation.

In general, consumers may withdraw from a distance purchase within 14 calendar days of physically receiving the product, without having to justify their decision.

The conditions, procedure, return costs, exceptions, condition of the product and refund times are set out in our Returns and Refunds Policy.

No provision of these Terms shall limit the consumer's legal rights regarding withdrawal, returns, refunds, lack of conformity or guarantees.

13. Legal guarantee of conformity

New products sold to consumers in the European Union are covered by the legal guarantee of conformity under the law of the consumer's country of residence (at least two years) from delivery.

A product must conform to the description, characteristics, functionality, compatibility, accessories, instructions and other conditions communicated before purchase.

Where there is a lack of conformity, the consumer may request the remedies provided for by the applicable legislation, including repair, replacement, a proportionate price reduction or termination of the contract, where applicable.

Any additional commercial guarantee offered by DatumCard or by a manufacturer is independent of and compatible with the legal guarantee, and will not reduce the consumer's rights.

14. Compatibility and use of technology products

Some DatumCard products may require compatible devices, operating systems, apps, user accounts, third-party services or networks in order to work properly.

The customer should check the compatibility indicated on the product page before making the purchase.

Features that depend on external services, such as location networks, mobile apps, map services, Bluetooth connectivity, operating system updates or third-party platforms, may be affected by technical changes, availability, coverage, device settings or decisions made by those third parties.

This clause does not limit DatumCard's liability where the product does not conform to the description or compatibility advertised before purchase.

15. Intellectual property

All content available on datumcard.es, including texts, images, logos, trademarks, designs, videos, graphics, icons, photographs, visual structure and other elements of the site, belongs to DatumCard, its licensors or their respective owners.

Use of the website does not grant the customer any intellectual property rights over such content.

Copying, reproducing, distributing, modifying, selling, commercially exploiting or creating derivative works from the content of the site without prior written authorisation is prohibited, except where permitted by the applicable legislation.

16. Third-party tools, apps and services

The website may integrate tools, apps, payment gateways, logistics services, analytics systems, marketing services, review apps, tracking services or other solutions provided by third parties.

These tools may be subject to their own terms and privacy policies.

DatumCard does not control every technical aspect of these external services, but their use does not limit the consumer's rights against DatumCard in relation to the purchase of products in our store.

17. Third-party links

The website may contain links to third-party websites or platforms.

When the customer accesses an external website, that site will be subject to its own terms, policies and practices. We recommend carefully reviewing the legal and privacy information of any third-party website before using it or carrying out transactions on it.

The inclusion of a link does not necessarily mean that DatumCard approves, controls or accepts responsibility for the content, products or services offered by that third party, except where the applicable legislation provides otherwise.

18. Relationship with Shopify

DatumCard uses Shopify's technology infrastructure to operate the online store.

However, unless expressly stated otherwise, the contract for the sale of products is concluded directly between the customer and DSJ CONNECT LLC, which operates under the brand Datum.

Shopify may provide technology, hosting, payment, analytics, security or other services related to the operation of the store. The processing of personal data associated with these services is governed by our Privacy Policy.

19. Privacy and data protection

The processing of personal data provided by the customer is governed by our Privacy Policy.

By using the website, the customer acknowledges having been informed about the processing of their personal data under the terms set out in that policy.

Use of the site does not imply consent to all data processing. Each processing operation will be based on the appropriate legal basis under the applicable regulations.

20. Comments, reviews and user-submitted content

Where the site allows reviews, comments, photos, videos, ratings or any other content to be posted, the customer guarantees that such content is lawful, essentially truthful and does not infringe the rights of third parties.

By submitting content for publication, the customer authorises DatumCard to use, reproduce, display, adapt the format of and publish it on the website, social media, advertisements or promotional materials related to DatumCard, always in compliance with the applicable legislation.

This authorisation is limited to content voluntarily submitted by the customer and does not imply the transfer of their moral rights or authorisation to alter the essential meaning of their review.

DatumCard may moderate, reject or remove content that:

  • Is false, offensive, discriminatory, defamatory or illegal.
  • Includes unnecessary personal data.
  • Contains spam, unauthorised advertising or malicious links.
  • Infringes intellectual property rights or the rights of third parties.
  • Is unrelated to the product or the shopping experience.

21. Prohibited uses

The customer may not use the website or its services to:

  • Carry out unlawful, fraudulent or deceptive activities.
  • Impersonate another person.
  • Infringe the intellectual property, privacy or image rights of third parties.
  • Introduce viruses, malware, malicious scripts or any harmful code.
  • Interfere with the security, availability or operation of the site.
  • Gain unauthorised access to systems, accounts or data.
  • Collect personal data of other users without a legal basis.
  • Use automated mass data extraction systems without authorisation.
  • Place fraudulent or abusive orders, or orders intended to circumvent promotional limits.

Breach of this section may result in suspension of access, cancellation of accounts, cancellation of fraudulent orders or the corresponding legal action.

22. Errors, inaccuracies and omissions

Although we try to ensure that the information on the site is accurate and up to date, errors, inaccuracies or omissions may occur in relation to prices, promotions, availability, descriptions, images, characteristics or delivery times.

DatumCard may correct errors or update information at any time.

If an obvious error affects an order already placed, we will contact the customer to inform them and offer, as appropriate:

  • To continue the order with the corrected information, if the customer agrees.
  • To replace the product with a suitable alternative, if the customer agrees.
  • To cancel the order and receive a full refund of the amounts paid.

Any minor or reasonable difference that does not affect the essential characteristics of the product or the consumer's rights will not be considered an obvious error.

23. Account suspension or cancellation

DatumCard may suspend or cancel a user's access where there are reasonable grounds, such as fraud, abusive use, serious breach of these Terms, malicious activity, attempts at unauthorised access or infringement of the rights of third parties.

The suspension or cancellation of an account will not affect the consumer's legal rights in respect of orders already placed, warranties, returns, refunds or pending claims.

24. Limitation of liability

DatumCard will be liable to the consumer under the terms established by the applicable legislation.

Nothing in these Terms excludes or limits DatumCard's liability where such exclusion or limitation is not permitted by law, including, among other cases:

  • Wilful misconduct or gross negligence.
  • Death or personal injury caused by conduct attributable to DatumCard.
  • Defective or non-conforming products.
  • Breach of essential contractual obligations.
  • Non-waivable rights of consumers and users.
  • Liability arising from data protection regulations.

To the extent permitted by the applicable legislation, DatumCard will not be liable for damage resulting from misuse of the product, unauthorised tampering, failure to follow instructions, modifications made by the customer or use incompatible with the product's purpose.

25. Website availability

We try to keep datumcard.es available and working properly. However, access to the site may be temporarily interrupted due to maintenance, updates, technical failures, third-party problems, cyber incidents or causes beyond our reasonable control.

Where possible, we will try to reduce the impact of such interruptions.

This section does not limit the consumer's rights in respect of purchases already made.

26. Indemnification for unlawful use

The customer may be liable for direct damage caused to DatumCard or to third parties where such damage results from unlawful, fraudulent, malicious or grossly negligent use of the website, an account or the services.

This clause will not apply to normal use of the store or to the legitimate exercise of consumer rights, such as complaints, return requests, warranty claims, refunds or communications with customer service.

27. Force majeure

DatumCard will not be liable for delays or failures to perform caused by external, unforeseeable or unavoidable circumstances beyond its reasonable control, such as natural disasters, conflicts, strikes, government restrictions, logistics disruptions, widespread service outages, cyberattacks or serious transport incidents.

Where such a circumstance affects an order, DatumCard will inform the customer when reasonably possible and will take proportionate measures to reduce the impact.

This clause does not remove the consumer's rights in the event of non-delivery, significant delay or definitive impossibility of performance.

28. Assignment or transfer

The customer may not assign their rights or obligations under these Terms without DatumCard's prior authorisation, except where permitted by the applicable legislation.

DatumCard may transfer its rights and obligations in the event of a business reorganisation, merger, acquisition, sale of assets, change of operating provider or business succession, provided that such transfer does not reduce the consumer's legal rights.

Where legally required, the customer will be informed of the transfer.

29. Severability

If any provision of these Terms is held to be invalid, unfair, void or unenforceable, that provision will be interpreted or limited to the extent necessary to comply with the applicable legislation.

The invalidity of one provision will not affect the validity of the remaining Terms.

30. Waiver

Failure or delay by DatumCard in exercising any right will not constitute a waiver of that right.

Any waiver will only be valid if made expressly and in writing.

31. Entire agreement

These Terms, together with the policies published on datumcard.es, constitute the contractual framework applicable to the use of the site and to purchases made in the store.

In the event of a conflict between these Terms and a specific policy, the specific policy will prevail with regard to the matter it governs, provided that this does not limit the consumer's non-waivable rights.

32. Changes to the Terms

DatumCard may update these Terms to reflect legal, technical, commercial or operational changes.

The current version will be available on this website and will show the date of the last update.

Changes will not apply retroactively to orders already placed, unless they are required by law or are favourable to the consumer.

Continued use of the site after changes have been published will constitute acceptance of the updated version for future use of the site and subsequent orders.

33. Governing law and jurisdiction

These Terms are governed by the applicable European Union law and the mandatory law of the consumer's country of residence, including the mandatory consumer protection rules that apply there.

Where the customer acts as a consumer, any dispute will be submitted to the competent courts and tribunals in accordance with the applicable legislation, respecting in all cases the jurisdiction of the consumer's place of residence where applicable.

Nothing in this clause shall limit the consumer's right to benefit from the mandatory protections provided for by the applicable legislation.

34. Complaints and customer service

If you have any questions, issues or complaints relating to a purchase, you can contact our customer service team at:

contact@datumcard.com

We recommend including your full name, order number, the email address used for the purchase and a clear description of the issue so that we can help you more quickly.

Submitting a complaint to DatumCard does not limit the consumer's rights before the competent authorities or the dispute resolution mechanisms available under the applicable legislation.
